1. Acceptance of Terms
By accessing and using LocalSaathi, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms at any time without notice. Your continued use of the service following the posting of revised Terms means that you accept and agree to the changes.
2. Services
LocalSaathi provides a platform for users to search for businesses, services, and professionals, and for businesses to list their information. We do not directly provide the services or products advertised on our platform. We act as an intermediary to connect users with businesses. All transactions, disputes, or claims between users and listed businesses are the responsibility of those parties.
3. User Accounts
Users must be at least 13 years old to use our services. You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to refuse service to anyone at any time.
4. User Content
By posting content on LocalSaathi, including reviews, photos, or business information, you grant LocalSaathi a worldwide, non-exclusive, royalty-free license to use, copy, distribute, and display that content. You warrant that you own or have obtained all necessary rights to the content you post. You agree not to post content that is illegal, offensive, defamatory, or violates the rights of others.
5. Prohibited Conduct
You agree not to: (a) post false or misleading information, (b) engage in harassment, spam, or abusive behavior, (c) interfere with our systems or services, (d) use automated tools to collect data, (e) post protected or confidential information, or (f) violate any applicable laws or regulations. We reserve the right to remove content and terminate accounts that violate these terms.
6. Liability Limitations
LocalSaathi and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability shall not exceed the amount paid by you in the past 12 months. Some jurisdictions do not allow the exclusion of implied warranties, so this limitation may not apply to you.
7. Disclaimer of Warranties
The services are provided on an "as is" basis without warranties of any kind. We make no representations or warranties regarding the accuracy, reliability, or completeness of the information on our platform. We do not warrant that our services will be uninterrupted or error-free. Users rely on information from listed businesses at their own risk.
8. Indemnification
You agree to indemnify and hold harmless LocalSaathi and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your content, or your violation of these terms. This includes attorney's fees and court costs.
9. Dispute Resolution
Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration under Indian law. You agree to submit to the exclusive jurisdiction of arbitration proceedings. Both parties waive the right to a jury trial and the right to pursue claims in a court of law.
10. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of India, and you irrevocably submit to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
11. Termination
We may terminate or suspend your account and access to our services at any time, without notice, if we believe you have violated these terms or engaged in conduct that is harmful to our platform or other users. Upon termination, your right to use the service will immediately cease.
